1. General provisions

1.1 These Terms and Conditions of Sale (the "Terms and Conditions") of FV Rackets e-shop (the "e-shop") apply to purchases made from the FV Rackets e-shop at www.fvrackets.ee. The seller of the goods is Tenniseakadeemia OÜ (hereinafter referred to as: the seller), address Haabersti 5, 13516 Tallinn, registration code 12716502, phone +372 5660 6001, e-mail address info@fvrackets.ee. The Terms and Conditions apply to all legal relations between the person (hereinafter referred to as: the customer) and the seller arising from the purchase of goods via FV Rackets e-shop.

1.2 The Seller has the right to unilaterally amend and supplement the Terms and Conditions by publishing the new Terms and Conditions at https://fvrackets.ee/muugitingimused/. If the customer has placed an order before the entry into force of the amendments to the terms and conditions, the legal relationship between the customer and the seller shall be governed by the terms and conditions in force at the time the order was placed.

1.3 The Customer will be able to save, print and, if necessary, reproduce the Terms and Conditions before making the purchase. By making a purchase from the online shop, the Customer agrees to the terms and conditions.

1.4 In addition to the Terms and Conditions, the legislation in force in the Republic of Estonia shall apply to purchases made from the e-shop.

2. Products in the e-shop

2.1 The e-shop may have products that are only available in limited quantities and are special editions. Products in limited quantities can be returned or exchanged in accordance with the seller's return policy.The e-shop cannot always guarantee the availability of products. If a customer places an order online and the product is not available, the e-shop will not be able to fulfil the order. In this case, the seller will contact the customer and offer a possible new availability date for the same product, a substitute product or refund the customer within 14 calendar days.

2.2 The product photos in the e-shop are illustrative but captured using the best solutions. The appearance of the Products on a computer monitor or smart device screen may differ to some extent from reality due to the accuracy of the colour reproduction of the device or monitor.

3. Placing an order

3.1 The customer selects the desired goods from the e-shop, chooses the product features (if any) and adds them to the shopping cart. 

3.2. Products are not reserved in the shopping basket.

3.3 The Customer chooses the method and place of delivery of the order.

3.4. The Customer confirms the shopping cart and pays for the goods in the payment environment offered by the Seller. The customer checks that the information on the invoice corresponds to the customer's actual request before paying the invoice.

3.5. After paying for the goods, the customer must click on the "Back to merchant" link.

3.6. The seller will send the client an e-mail confirmation of receipt of the order and payment.

3.7 The sales contract between the Seller and the Client shall enter into force from the date of receipt of the full amount of the purchase price paid by the Client into the Seller's current account.

3.8 In the absence of the product ordered by the Client, the Seller cancels the order. The order may be cancelled in whole or in part. The customer will be immediately informed of the cancelled order. In the case of a partial cancellation, the seller may ask the customer's preference as to how to deal with the remaining order - either to dispatch it or to cancel it as well.

4. Price of goods, payment options

4.1 All prices of goods sold in the e-shop are shown in euros and include VAT.

4.2 The Customer shall pay the full amount of the sales price and delivery charges in advance for the order. Payment is made outside the e-shop in a secure environment. The Seller has no access to the customer's bank and credit card details.

4.3. A service fee may be added to the cost of the order in accordance with the agreement concluded between the customer and the issuer of the bank or credit card.

5. Receiving the goods

5.1 The goods can be delivered to a SmartPost parcel machine or to the address entered by the customer, using the SmartCourier service.

5.3. Receiving the goods from a SmartPost parcel terminal.

5.3.1 Delivery of the goods to the Smartposti parcel terminal chosen by the customer is free of charge within Estonia.

5.3.2 The goods will be dispatched within 1-2 working days and will arrive at the parcel machine within 1-2 working days after dispatch.

5.3.3 The Customer shall be informed of the arrival and location of the Shipment by SMS. The message will contain the door code necessary to open the door. The storage time of the parcel in the parcel machine is 7 calendar days.

5.3.4 In the event that the client has not accepted the goods from the parcel machine after the expiry of the deposit period, the seller will consider that the client has cancelled the order and the seller will refund the purchase amount together with the delivery fee to the client without delay, but not later than within 14 calendar days to the same account from which the purchase was paid. 

5.3.5 The Seller shall not be liable for any loss or damage incurred by the Customer if, for reasons beyond the Seller's control, third parties have obtained possession of the unique code of the parcel machine and the goods have been delivered on the basis of that code.

5.4. Delivery of goods by SmartCourier within Estonia

5.4.1 The SmartCourier service is free of charge within Estonia.

5.4.2 Goods delivered by SmartCourier will be delivered to the address indicated by the customer within 2-3 working days after the sales contract enters into force, from Monday to Saturday between 9.00 and 21.00. The customer can choose the time of day (9.00-17.00 or 17.00-21.00 or 9.00-21.00) and order the goods to work or home. On the morning of the day of delivery, the customer will be informed of the arrival of the parcel by SMS. The courier will call the customer before delivering the parcel. According to the customer's wishes, the parcel can also be redirected to a suitable parcel machine at no extra charge. The parcel will be handed over to the customer on the basis of a unique code which will be sent to the customer by SMS.

5.4.3 The Customer must ensure that the Goods are received at the agreed time and address. If the Customer is not available at the time of arrival, the courier will return the parcel to the SmartPost terminal. When the parcel is returned to the terminal, the system will send an SMS to the Customer. The customer then has the possibility to agree with the SmartPost customer service on a new time for the next delivery attempt by the courier.

5.5. Receiving goods by SmartCourier abroad

5.5.1 Goods can be delivered to Estonia, Latvia, Lithuania, Finland, Sweden and Russia.

5.5.2 When ordering from abroad, a delivery fee corresponding to the destination chosen by the customer will be added when placing the order. The delivery method is selected and the delivery charge is calculated in the shopping cart. Depending on the destination, there will be a delivery charge:

Latvia: €9, Lithuania €9, Finland €17, Sweden €23 EUR, Russia €45.

5.5.3 Goods delivered by SmartCourier will be delivered to the address indicated by the customer within 6-8 working days after the sales contract enters into force.

5.6. Control of goods

5.6.1 Upon receipt of the goods, the customer undertakes to open the product packaging carefully, without damaging the packaging and the products. If the customer has damaged the packaging due to negligence, i.e. it was possible to open the packaging without damaging it, the seller has the right to claim compensation for the damage caused. If the product packaging cannot be opened intact, the customer is not liable for the damaged packaging.

5.6.2 In the event that the customer discovers upon receipt of the goods that the goods have been sent to him/her incorrect or defective goods or that the goods do not reach the customer in good condition and in sealed packaging, the seller's customer service must be informed immediately by telephone +372 5660 6001 or by e-mail info@fvrackets.ee.

5.6.3 The Seller shall be responsible for the goods purchased by the Customer during their transport. The risk of damage to or loss of the goods shall pass to the Customer upon receipt of the goods.

6. Processing of customer personal data

6.1 The Seller processes the personal data entered by the customer in the e-shop (including name, telephone number, address, e-mail address, telephone) primarily for the purpose of fulfilling the order and delivering the goods to the customer in accordance with the Seller's Privacy Policy.

7. Return of goods, withdrawal and refunds

7.1 The Customer has the right to withdraw from the contract without giving any reason within 14 calendar days from the date of receipt of the goods (except in case of defects in the product, see clause 8), by contacting the e-shop customer support by phone +372 5660 6001 or by e-mail at info@fvrackets.ee.

7.2 The Client is obliged to return the goods to the Seller within 14 days from the date of submission of the return request.

7.3 The Customer may exercise the right to withdraw from the contract if the goods are unused and undamaged. We advise the customer to return or deliver all the goods he wishes to return in one go. We recommend returning the goods in their original transport packaging.

7.4 The returned goods must be unused and undamaged. It is not possible to return products with the product label with the product price, product name and product codes removed. The customer has the right to inspect the goods in the manner normally permitted in a shop and the customer is liable for any depreciation of the goods during inspection if the goods have been used in any other manner than that described above.

7.5 In case the client has withdrawn from the transaction, the seller will return the purchase amount to the client, together with the delivery fee, without delay, but not later than 14 calendar days after the withdrawal notice reaches the seller. The refund will be made to the same bank account from which the purchase was paid.

7.6 If the customer has intentionally or negligently damaged or damaged the goods to be returned, the seller has the right to refuse to take back the goods or to claim compensation for the damage caused.

7.7. The transport of the returned goods is paid by the customer, unless the goods are defective. The amount for the transport of defective goods will be refunded by the seller to the customer's account from which the purchase was made.

8. Exchange of goods

8.1 In the event that the Customer wishes to exchange or replace the Product, the Customer must contact info@fvrackets.ee In the event of exchange or replacement, the Customer shall bear all direct costs associated with the return of the Product, unless the Product being returned is defective.

8.2 If the product returned by the seller cannot be exchanged due to lack of the size requested by the customer, the seller will contact the customer.

9. Submission of a claim and liability

9.1 The Seller shall be liable for any non-conformity of the purchased goods for a period of 2 years from the date of delivery of the goods to the Customer. In the case of a sale of goods to a customer, it shall be presumed that the non-conformity with the terms of the contract which became apparent within 6 months from the date of delivery of the goods to the customer existed at the time of delivery of the goods, unless such presumption is incompatible with the nature of the goods or the nature of the defect. The customer undertakes to inform the seller of the lack of conformity of the goods within 2 months of its discovery at the latest, i.e. to lodge a complaint.

9.2. The customer can submit a complaint by e-mail to info@fvrackets.ee. The complaint must state the name and contact details of the customer, the date of the complaint, the defect of the goods and the content of the claim, and must be accompanied by proof of purchase.

9.3 The Seller shall not be liable for any loss or damage or any other consequences, including delay in delivery, arising from incorrect information provided by the customer in the performance of the order, if this is due to circumstances beyond the Seller's control.

9.4 The Seller shall not be liable for any damage caused by improper use of the ordered goods.

9.5 Disputes between the Seller and the Customer shall be settled by negotiation. In case of failure to reach an agreement, the customer has the right to apply to the Consumer Protection and Technical Regulatory Authority's Consumer Environment Department (Pronksi 12 Tallinn 10117, https://www.ttja.ee) and the Consumer Disputes Committee (Pronksi 12 Tallinn 10117, http://www.komisjon.ee) for out-of-court settlement of the dispute or to the Harju County Court. In addition, the European Union's ODR (Online Dispute Resolution) platform is open to all customers for resolving complaints with e-retailers at http://ec.europa.eu/odr.

10. Montonio after-tax and Split use

10.1 Montonio instalment: one application - multiple offers
Use Montonio instalment to pay - one application gets you offers from multiple
creditors. Add the products you want to buy to your shopping cart and select the Montonio instalment facility as the payment method.
Select the appropriate contract period and complete the application. Through the instalment facility, you will receive financing offers from several
creditors. Check the terms and conditions and choose the one that suits you best.
Terms and conditions for instalments:

  • Interest starting from 5.9% on the initial amount

10.2 Montonio Split: one big purchase - three small payments.
Use the Montonio Split payment solution - pay for your purchase later in the same month or in three
months in three equal instalments.
Add the products you want to your shopping cart and choose Montonio Split as your payment method. You can pay for your purchase after 30
days, in two instalments over two months or in three instalments over three months. If you wish, you can pay
the entire purchase amount at once, at a time of your choice, before the due date.
